eDelivery – From when? Check the deadlines

In a communication from 12 July 2024, the Minister of Digital Affairs revised the deadline for the implementation of eDelivery (the technical solutions necessary for the delivery of correspondence via the public registered electronic delivery service and the public hybrid service) by entities specified in the Electronic Deliveries Act. The deadline for mandatory eDelivery implementation has been postponed to 1 January 2025.

When does the obligation to use the National Electronic Delivery system begin?

According to the Act of 18 November 2020 on Electronic Deliveries and the latest communication from 12 July 2024, the schedule for individual entities is as follows:

Public entities

By 1 January 2025

The exact date will be specified in a communication by the Minister of Digital Affairs. According to the adopted amendment, the deadline for the eDelivery obligation cannot be later than 1 January 2025.

  • Government administration bodies and the budgetary units serving them
  • Public authorities other than those listed above, including state control and law enforcement bodies, and their supporting budgetary units
  • The Social Insurance Institution (ZUS) and the funds it manages, as well as the Agricultural Social Insurance Fund (KRUS) and funds managed by the President of the KRUS
  • The National Health Fund
  • Executive agencies, budgetary economy institutions, state special-purpose funds, independent public healthcare institutions, public universities, the Polish Academy of Sciences and its organizational units, state and local government cultural institutions, and other state or local government legal entities established under separate acts to perform public tasks
  • Local government units and their associations, metropolitan unions, and local government budgetary units (excluding hybrid service from 1 October 2029)

From 1 January 2025

  • Public entities other than those mentioned above

From 1 October 2029

  •  Courts and tribunals, bailiffs, prosecutors, law enforcement agencies, and the Prison Service

 

Non-public entities

By 1 January 2025

According to the adopted amendment, the deadline for the eDelivery obligation cannot be later than 1 January 2025 for trusted professions, particularly:

  • Practising lawyers
  • Practising legal advisers
  • Practising tax advisers
  • Practising restructuring advisers
  • Practising patent attorneys
  • Practising notaries
  • Advisers of the General Counsel to the Republic of Poland performing official duties

Additionally:

  • New entrepreneurs registering in the National Court Register (KRS)

 

From 1 January 2025

  • New entities registered in the Central Register and Information on Economic Activity (CEIDG)

 

From 1 April 2025

The exact date depends on the date specified in the communication by the Minister of Digital Affairs:

  • Non-public entities registered in the National Court Register (KRS) as of 31 December 2024


From 1 July 2025

  • Entities registered in the Central Register and Information on Economic Activity (CEIDG) as of 31 December 2024, if they submit a request for any change

 

From 30 September 2026

  • Entities registered in the Central Register and Information on Economic Activity (CEIDG) as of 31 December 2024
