Frequently asked questions
What is an electronic signature?
An electronic signature is a digital method of signing documents that indicates your agreement or approval of the document’s content.
It's the online equivalent of a handwritten signature, but even more secure thanks to its various identity verification methods.
E-signature can be as simple as checking an “I agree” box on a website, writing out your name with a stylus on a mobile phone screen, or more secure, like Simple Electronic Signatures (SES) collected with electronic signature software platforms.
Is electronic signature legally binding?
Electronic signatures are legally binding thanks to the set out by governments regulations. For example, it’s the eIDAS (electronic IDentification, Authentication and trust Services) regulation that sets out the standards for electronic signing across the European Union.
Corresponding to eIDAS, there are mirroring regulations across the globe, such as the E-Sign act in the United States, the ETA (Electronic Transactions Act) in Australia, or the Federal Act on Electronic Signatures (ZertES) in Switzerland.
Given the fact that e-signatures are lawfully recognized, electronic signatures can be admissible in court cases as evidence.
Is digital signature different from electronic signature?
Digital signature is a special type of electronic signature, meaning that every digital signature is an electronic one, but not every electronic signature is digital.
To put it simply, digital signatures differ from e-signatures in the authorization process—as in they require identity verification of the signing party. The identity verification for digital signatures can be completed in several ways. From simply photographing your ID card to a video conference with a Certificate Authority for Qualified Electronic Signatures (QES).
No matter the method, all verification processes can be completed quickly, and usually completely online.
Besides the identity verification process, digital signatures offer advanced security thanks to Public Key Infrastructure (PKI) technology used for encryption of the signatures, and the digital certificate issued for each qualified signature.
What are the types of electronic signatures?
There are three main types of electronic signatures:
- Simple Electronic Signatures (SES)—can be used for 90% of documents in business transactions, from simple cooperation agreements to contracts of mandate or contracts for the sale of movable property.
- Advanced Electronic Signatures (AES)—suitable for more complex documents, like sales intermediary agreements or reservation agreements.
- Qualified Electronic Signatures (QES)—for the most demanding documents and clauses, like transferring copyrights in a contract or signing loan agreements.
SES signatures are completely secure and very universal in nature, fitting many documents. Here, you’ll authorize the identity of the signing party with their basic details, like name and surname and an additional verification done with a unique code sent to their email address or phone number.
AES and QES signatures require additional identity verification, reviewing the signing party’s ID card, for example, through a photograph or a video verification.
With Autenti as your electronic signature software, you can use all three e-signature types for an unlimited number of documents.
Which e-signature type should I use?
The type of e-signature you should use depends on the specific document you need to have signed. However, 90% of documents in business transactions can be safely signed with SES (Simple Electronic Signatures).
For more intricate or complex clauses, like transferring copyrights in an employment contract, choose AES or QES signatures, all available on Autenti.
