European organizations are increasingly moving their business processes into digital environments. According to Eurostat, more than
74% of European SMEs have already achieved a basic level of digitalization. As a result, an increasing number of processes, from employee onboarding and contract execution to business documentation management, are now conducted entirely online.
In the DACH region, however, digital transformation goes hand in hand with strict regulatory requirements. In many business scenarios, a standard electronic signature is not sufficient. Instead, organizations must use a Qualified Electronic Signature (QES) that complies with eIDAS regulations and local legal requirements.
Under the EU's eIDAS regulation, a qualified electronic signature has the same legal effect as a handwritten signature throughout the EU. In Germany, §126a BGB requires a qualified electronic signature wherever statutory written form is replaced by electronic form. Switzerland operates under its own ZertES framework: equivalence with written form requires a qualified certificate from a recognised Swiss provider together with a qualified timestamp, and Switzerland currently has no mutual recognition agreement with the EU for qualified signatures.
For organisations working across all three markets, this is not a legal footnote. It determines which signature, from which provider, is valid for which contract.
A qualified electronic signature is not simply a click. Each document typically requires a controlled signing context, authentication of the signer, certificate selection, an explicit consent or authorisation step, and evidence handling. For a single contract, that is a reasonable amount of friction. Multiply it by five hundred and it stops being a formality and becomes a project. One architecture practice told us that signing the documents for a single public tender takes an entire working day.

In regulated markets, organisations usually cannot solve this by moving to a simpler signature level. The required signature level is fixed. Only the process around it can change.
